RathGibson fined $150K for violating the Resource Conservation and Recovery Act

During its investigation, the EPA discovered that RathGibson had violated several requirements under the RCRA statute.

RathGibson LLC has reached a settlement with the U.S. Environmental Protection Agency (EPA). The company, which manufactures precision welded tubing and pipe for energy and industrial applications, allegedly violated the Resource Conservation and Recovery Act (RCRA) at its facility in Janesville, Wisconsin. According to the EPA, the RCRA is used to govern the management of solid and hazardous waste to protect human health and the environment.

During its investigation, the EPA discovered that RathGibson had violated several requirements under the RCRA statute. This included:

  • Storing hazardous waste for more than 90 days on-site without a hazardous waste storage license
  • Not training employees whose job responsibilities included hazardous waste management
  • Failing to make and to complete hazardous waste determinations
  • Not marking start dates of accumulation visibly and accurately on containers
  • Failing to label and to close satellite accumulation containers

RathGibson has already addressed the alleged violations and has agreed to pay $150,356 in civil penalties.
